Family reunification visa Poland

The Polish government has developed a family reunification visa Poland program for foreigners. It allows a foreigner to legalize family members on the territory of Poland or the family of a citizen of the Republic of Poland.

Anyone who stays legally in Poland, has got a residence card or applies for it (temporary or permanent residence permit ), may reunite with family. This process is known as family reunification in Poland.

What is family reunion visa Poland?

Family reunification visa Poland - this is a generalized name for all possible ways of legalizing family members of a foreigner who stays legally on the territory of Poland, or a citizen of the Republic of Poland.

There is only one basis that can be specifically attributed to “reunification”, but many people are accustomed to calling any possibility of legalizing a family member as 'reunification'. Due to such an erroneous opinion, you can incorrectly indicate the type of basis, collect the wrong documents and, as a result, get a refusal on the residence card.

Who is entitled to Poland family reunification visa?

Family members are meant:

  • any spouse who is in an official or unofficial «common-law» marriage;
  • native, adopted children, including those from previous marriages, if they are dependent;
  • parents and leagal guardians of minor foreign refugees or those who are under the supplementary protection program.

Family members must be citizens of a non-EU country.

It is necessary to single out the category of parents separately. Naturally, there is a desire to bring them to Poland, especially if they are already retired. They don’t fit the classic family reunion options, but there are chances to bring retired parents. To do this, you will have to prove that they need your care for health reasons or they are in a difficult financial situation in their native country. Under the same circumstances, you can bring your brothers, sisters, foster parents, grandparents.

What benefits will a family member receive after reunification?

Depending on the actual basis, the benefits for each family member will differ.

For all options they are:

  • Free travel throughout Europe for 90 days every six months.
  • Unrestricted EU border crossing.
  • Legal stay in Poland for the entire duration of the residence card.

If a family member is going to be reunited with an applicant who is a Polish citizen, or a foreigner who has already obtained a residence card, they will receive additional benefits:

  • The prospect of becoming a citizen of Poland in the future.
  • Access to the labor market. This implies that you will not need a work permit.
  • The right to become an individual entrepreneur.
  • Access to financial assistance for children.
  • Possibility to join children to your residence card.
  • Possibility to register an apartment, car, get a loan and a mortgage.
  • Access to Polish programs on education, medicine, etc.

What conditions must the applicant (inviting his family) meet?

Basic requirements:

  • legal stay in Poland. No overstayed visas, visa-free travel and expired temporary residence cards.
  • being officially employed, study, or be classified as a refugee, receive additional protection from the state.

You must also meet one of the additional availability requirements:

  • polish citizenship.
  • permanent residence card (permit).
  • residence permit (TRC) for 2 years.
  • residence permit for the purpose of scientific research.
  • EU Blue Card.
  • grounds for obtaining a residence card and submitting documents together with the family.

How to get a residence card for a child?

Children in addition to the temporary card can also receive a permanent residence card.

A child can obtain permanent residence if he was born during the validity of:

  • permanent residence of one of the parents;
  • residence permit of a parent who later got permanent residency.

In other cases, the children of a foreigner can only obtain a residence permit on the general basis.

If the parent or guardian is a citizen of Poland, then the child may apply for Polish citizenship.

For how long are residence cards issued to family members?

Family members receive residence cards for a period not exceeding the validity period of the inviter's residence card. The minimum term is 3 months. The maximum is 3 years.

The maximum validity period of 2-3 years is issued to those who are being reunited on the card of an inviting foreigner who resides permanently, or is a citizen of Poland.

Examples of family reunification in Poland

Reunification of wife and husband. The husband has a residence card and a job. The wife wants to move in with her husband and does not plan to work.

Relocation of children to a parent in Poland. By joining them to their residence card, children can live and study in Poland.

Reunification of a couple in a civil marriage. The absence of a marriage certificate greatly reduces the chances of obtaining a residence card, but you can try it by having collected evidences of your cohabitation.

Step-by-step instructions for family reunification

Any family member who is 18 years of age or older can initiate the submission of documents for a residence card. The applicant is supposed to be in Poland.

First you need to decide in which city the application will take place. The requirements for documents differ from one voivodship to another. There are also different time frames and statistics for positive decisions. In order to apply in the desired voivodeship, you must have the appropriate registration or lease agreement. In some cases, according to the new law of January 29, 2022, the address of the employer is considered to be your location if you obtained a residence card on work purposes and without being registered at a certain place.

Next, you need to decide how the submission will take place. There are 2 options: personal and by mail. Many voivodeships during a pandemic accept applications only by mail. If you send an application by mail, then in a few months you will receive a receipt for fingerprinting and reporting documents.

This method is suitable if you are the inviting side and your family is not yet in Poland. And remember to ensure that your mail address does not cause any problems with receiving mail.

If you immediately book an appointment for a personal application, then you need to bring all the required documents and be fingerprinted immediately. Only children under 6 years of age are exempted from the obligation of biometric data (fingerprints) and personal presence.

Required documents

All documents in Russian and other languages must be translated into Polish by a sworn translator. All applications are filled in only in Polish.

Depending on the voivodeship, the list of documents, the number of copies required is different.

Indicative list of documents to be collected:

  • application (1-4 copies),
  • photo 35x45 mm (4 pcs.),
  • photocopy of passport (1-2 copies),
  • birth, marriage, adoption, guardianship certificates,
  • an employment contract confirming the coverage of your expenses for the maintenance of the family,
  • additional extracts and certificates depending on the type of employment contract,
  • legitimation from an educational institution for students,
  • rental agreement or registered address,
  • health insurance or ZUS ZCNA,
  • proof of payment of stamp duty (PLN 170 or PLN 340).

You should be very careful when filling out an application (wniosek). Each item and information that you enter there will be checked. Incorrectly indicated grounds, lack of evidence provided for the specified information, may lead to refusal.

Processing time

The timing depends on factors such as:

  • in which voivodeship you apply. For example, it is fast in Warsaw, while in Gdansk it is very slow.
  • submition by mail or by personal appointment. In this case, the waiting period is increased by waiting for fingerprinting. As soon as you have been fingerprinted, the countdown of processing your case begins.
  • how complete and comprehensive package of documents you have provided. The inspector will not have to waste time on requests to convey any documents. And the absence of any document can lead to an increase in the consideration period by another couple of months.
  • whether there were any changes in the processing of the case, whether you conveyed relevant information.
  • whether you have grounds for expediting the case.

The entire period of your case processing allows you to stay in Poland legally.

If you have sent documents by mail and have not yet been fingerprinted, then your acknowledgement of receipt of documents (yellow card) gives you the right to stay legally. After you have been fingerprinted, your passport will have a red stamp, which also confirms your legal residence.

However, after the expiration of the visa, you will not be able to leave Poland and enter back with just one stamp.

Getting a decision

The decision (decyzja) will be sent to your mail upon application. A refusal (negative decision) may be appealed within the prescribed time limit.

After receiving a positive decision, plastic can be picked up a few weeks later. Before you pick it up you have to pay 50 zlotys.

Reasons for refusal of family reunification

  • incorrectly selected basis and other errors in the application,
  • lack of important documents,
  • wrong address for correspondence, lost letters from the inspector,
  • false data in the application, violation of Polish law,
  • illegal stay in Poland,
  • insufficient evidence of your data and intentions.

You have the right to appeal within 14 days from the date of receipt of the decision. Otherwise, you will have to leave the country if there are no other legal grounds to be there.

If you receive a negative appeal decision, you have the right to appeal to the administrative court within 30 days. But in this case, filing documents with the court does not make your stay legal.

What other options could there be for family members besides reunification?

Any family member can apply for any other reason: work, study, other circumstances. The last point includes very extensive bases according to which you can try to apply.

How can I bring my parents to Poland?

This is a private issue, when, for example, a husband, brother, son are in Poland, and you would like to join them.

Depending on the basis on which he is in Poland, you can get different reasons for arrival and stay.

What will you receive as part of the family reunification service?

Questions and Answers

How long does it usually take to process a case?

It all depends on the voivodeship in which you will apply. At the moment, for example, in Warsaw it is about 4 months, and in Gdansk you can wait up to a year.

What conditions must be met by family members who apply for reunification on my Temporary Residence Card?

On their part, only the presence of fingerprints (not applicable to children under 6 years). They may not study or work, provided that your income covers their maintenance.

In what cases can I get a permanent residence permit through family reunification?

You need to fulfill 2 conditions:

— You must have a temporary residence card for at least 2 years.
— You must be married to a Polish citizen for at least 3 years.

These conditions are not cumulative. The minimum term can be 3 years for everything.

At the same time, if your spouse has just acquired Polish citizenship, then the previous time in marriage will not be taken into account. Those. your spouse to those requirements must be in the status of a Polish citizen for 3 years. Family reunification visa Poland requirements include having a legal stay in Poland, being officially employed or studying, and meeting additional availability requirements such as having Polish citizenship, a permanent residence card, or a Karta Pobytu for 2 years.
