Changing job in Poland for foreigners (Poland TRC decision)
The transition to a new job with work recidence permit is a procedure faced by many migrant workers in Poland. However, making a transfer is not an easy legal procedure. When processing a change of employer, it is required to correctly issue an application and collect a package of documents, notify the current and future employer, and monitor the process of consideration in the migration service. Numerous pitfalls of this process can lead to a refusal of the Poland TRC decision or even to the cancellation of a residence permit.
What is a job amendment?
A change of work for a residence permit in Poland is considered:
- Transfer to another employer (requiring an employment authorization document)
- Change of position or profession at the same employer
- Changing the form of employment (for example, from an employment contract to a civil one)
The documents and work permits remain valid. However, it is necessary to notify the relevant authorities of the changes within 14 days.
Ignoring this requirement entails an administrative penalty in the form of a fine.
Documents for amendment of the decision
- Statement of intention to change decision on the official letterhead
- A copy of the current TRC will be available
- A copy of the pages with personal data in the passport
- An employment contract with a new employer
- Payment documents confirming payment of the state duty
The package is sent to the Voivodeship Office for Foreigners at the place of stay to consider the possibility of changing the decision.

During the examination of the documents, a foreign citizen has the right to stay in Poland and work for his former employer. - Lack of a work permit from a new employer
- Inconsistency of the new position with the qualifications or education of the employee
- The foreigner has previously been brought to administrative or criminal responsibility
Therefore, before applying for a change of decision, it is important to make sure that all the necessary legal conditions for moving to a new place of work in Poland are met.
The validity period of the TRC will be after the change of work / conditions
After a change of employer or other employment conditions, the validity period of the card does not change. It continues to be valid until the end of the initial period for which it was issued. For example, if the card was initially received for 3 years, this period is not shortened after the change of employer.
The exception is the cases of dismissal of a foreigner within the first 6 months from the date of receipt of the visit card. Then the document will be canceled and you will need to get a new TRC with new place of work.
But if the change of employer or conditions occurs after 6 months from the beginning of the validity of the card, it remains in force until the original expiration date.
What happens if you don't notify the fund about the job change?
This is an administrative offense. As a punishment, the migration service may:
- Issue a warning
- Impose a monetary fine of up to 5,000 zlotys
- Revoke the work permit
- Cancel the validity of the TRC for a short time and request departure from Poland
